Georgia Open Records Access
The Georgia Open Records Act gives every citizen the right to inspect and copy public records from state and local agencies. Public records include documents, papers, letters, maps, books, tapes, photographs, and computer based information that any agency prepares or receives. Violations of the Open Records Act carry penalties under O.C.G.A. § 50-18-74. A knowing violation is a misdemeanor with a fine up to $1,000 for the first offense. A negligent violation can bring a civil penalty of up to $1,000. Additional violations within 12 months can cost up to $2,500 each. A good faith defense is available. Superior courts have jurisdiction to hear enforcement actions under O.C.G.A. § 50-18-73, and the Attorney General has authority to bring such actions as well.
